Goods and Services Tax

Celcom has registered for GST with the Royal Malaysian Customs Department (RMCD) and has successfully implemented GST requirements internally. In accordance to the GST Law, Celcom will charge 6% GST on the applicable goods and services from 1 April 2015.

GST is a consumption tax based on the value-added concept, which would be imposed on goods and services at every production and distribution stage in the supply chain. Similar to most other services, our telecommunication services will be subject to GST at 6% standard rate, except for international roaming services and other zero rated services. Beginning 1 April 2015, the GST will replace service tax currently being imposed on applicable Celcom services.

Generally, all telecommunications products and services are subject to 6% GST, except for international roaming and other zero rated services and devices sold in DA (Tioman, Labuan & Langkawi - out of scope).

For prepaid users, you will not be charged GST for the VAS/ Content that you purchased, as GST has been paid upon reload.


For postpaid users, you will be charged 6% GST for the price of VAS/ Content purchased, and you will be able to see the total GST paid for the month in your monthly statement.


For direct payment (e.g. via credit card) 6% GST will be displayed upon payment.

Big Win Website’s Terms of Service


Introduction


Big Win Website (“Site”) is made available by Celcom Mobile Sdn Bhd (Company No 27910-A) or its affiliates (“Celcom”) to provide quizzes and contest service (“Service”) offering a selection of quizzes and contests but not limited to text, graphics, layout, interface, logos, photographs, audio and video materials and stills (collectively hereinafter referred to as the “Content”) to you.


By activating your account and using the Service, you agree to be bound by these terms of service (“Terms of Service”). If you are a Celcom customer, you also agree to be bound by the terms and conditions of the Customer Registration Form (CRF) and/or terms and conditions of the respective mobile/content service(s) offered and relevant to the you in respect of this Service as posted on Celcom’s website at www.celcom.com.my.


In the event of a conflict or inconsistency between these Terms of Service and the terms and conditions of CRF and/or terms and conditions of the respective mobile/content service(s) (if applicable) such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these Terms of Service (ii) terms and conditions of CRF and/or the respective mobile/content service(s).


These Terms of Service shall come into effect upon your acceptance of the Terms of Service when you click the “I Agree” button upon your initial access to the Site.

1.1 The Service shall be made available from 20th of August onwards until terminated by Celcom.


2.1 You shall be responsible to ensure that your mobile equipment (“Equipment”) is compatible to provision the Service. In the event that changes and upgrades are introduced to the Service, you shall be responsible to ensure the continued compatibility of the Equipment and you shall have no claim whatsoever against Celcom arising therefrom.

3.1 Big Win Account

 

3.1.1 You may use the Service upon your creation of an account (“Account”) at the Site.

 

3.1.2 Subject to Clause 3.1.1 above:

(i) you shall provide up to date, accurate and complete personal information for the purpose of the creation of the Account and you shall keep Celcom informed of any changes to your personal information;

(ii) keep your username and password created under the Account confidential at all times and not release the same to any person;

(iii) you shall be responsible for any activities or charges incurred under your Account whether such activities or charges were authorised by you; and

(iv) you shall inform Celcom as soon as reasonably practicable of any unauthorised usage of your Account.

 

3.1.3 Upon creation of the Account, you may have access to the Content made available at the Site.

 

3.1.4 Except for access to chargeable Content, you are not required to be a Celcom subscriber to have access to the Site and/or the Content.

 

3.1.5 You agree that by clicking the “I Agree” button or by continuing to use the Services, you are giving consent to Celcom that the information collected by Celcom from you (“Personal Information”) will be used and/or disclosed in accordance with Celcom’s Privacy Notice as posted at www.bigwin.com.my and Personal Data Protection Act. 2010. You are advised to read the Privacy Notice to understand your rights with regards to your Personal Information.

 

3.2 Your License

 

3.2.1 Celcom grants you a non-exclusive limited license to use the Service at the Site, including accessing and viewing the Content for personal, non-commercial purposes in compliance with these Terms of Service.

 

3.3 Content

 

3.3.1 The Content may be provided by third-party content providers. Celcom does not filter or edit the Content. You acknowledge that Celcom is under no obligation to censor the Content or information provided even if it is co-branded or promoted by Celcom. You agree that that Celcom does not generally and is not required to monitor or edit the use to which you use the Sites, the Service or the Content and Celcom is excluded from all liability of any kind arising from the use of the Service, and in particular but without limitation to the foregoing, the nature of any Content. Notwithstanding the foregoing, Celcom reserves the right to edit or remove any Content at any time as Celcom deems necessary, in order to prevent any breach of the Terms and Conditions or any breach of applicable laws or regulations.

 

3.3.2 Each contest or quiz shall be subject to its specific terms and conditions as displayed on the Site.

 

3.3.3 The prizes offered with the Content (if applicable) may be provided by third parties. Celcom disclaims any warranties or liabilities for the merchantability and fitness of the prize under this Contest. The warranties applicable for the prize are subject to the terms and conditions provided by the manufacturer or supplier of the prize.

 

3.5 Prohibitions

 

3.5.1 You shall not:

(i) use, display, mirror or frame the Site, or any individual element within the Site, Celcom’s and/or Big Win’s name, trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Celcom’s express written consent;

(ii) access, tamper with, or use non-public areas of the Site, Celcom’s computer systems, or the technical delivery systems of Celcom’s providers;

(iii) attempt to probe, scan, or test the vulnerability of any Celcom system or network or breach any security or authentication measures;

(iv) avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Celcom or any of Celcom’s providers or any other third party (including another user) to protect the Site, Services or Content;

(v) attempt to access or search the Site, Services or Content or download Content from the Site or Services through the use of any engine, software, tool, agent, device or mechanism but not limited including spiders, robots, crawlers, data mining tools or the like other than the software and/or search agents provided by Celcom or other generally available third party web browsers;

(vi) send any unsolicited or unauthorised advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;

(vii) use any meta tags or other hidden text or metadata utilising an Celcom trademark, logo URL or product name without Celcom’s express written consent;

(viii) use the Site, Services or Content for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms of Service, unless expressly permitted;

(ix) forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site, Services or Content to send altered, deceptive or false source-identifying information;

(x) attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services or Content;

(xi) interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;

(xii) collect or store any personally identifiable information from the Site or Services from other users of the Site or Services without their express permission;

(xiii) impersonate or misrepresent your affiliation with any person or entity;

(xiv) violate any applicable law or regulation;

(xv) encourage or enable any other individual to do any of the foregoing; or

(xvi) share your Account with any other person or entity;

(xvii) directly or through the use of any device, software, internet site, web-based service, or other means remove, alter, bypass, avoid, interfere with, or circumvent any copyright, trademark or other proprietary notices marked on the Content or any digital rights management mechanism, device, or other content protection or access control measure associated with the Content including geo-filtering mechanisms without Celcom’s prior written consent;

(xviii) directly or through the use of any device, software, internet site, web-based service, or other means copy, download, stream capture, reproduce, duplicate archive, distribute, upload, publish, modify, translate, broadcast, perform, display, sell, transmit or retransmit the Content without Celcom’s prior written consent;

(xix) incorporate the Content into, or stream or retransmit the Content via any hardware or software application or make the Content available via frames or in-line links without Celcom’s prior written consent;

(xx) create, recreate distribute or advertise an index of any significant portion of the Content without Celcom’s prior written consent; and

(xxi) create derivative works or materials that otherwise are derived from or based on in any way the Content including but not limited to montages, mash-ups and similar videos, wallpaper, desktop, themes, greeting cards and merchandise without Celcom’s prior written consent.

 

4.1 Subject to clause 3.1.4 above, you may be charged with the respective charges displayed prominently at the Site (“Charges”) prior to your purchase or subscription of the Content. The Charges will be:
(i) deducted from your account if you are a Celcom prepaid mobile subscriber; and
(ii) reflected in your next bill if you are a Celcom postpaid mobile subscriber.


4.2 Notwithstanding the Charges imposed in Clause 4.1 above, you shall be charged with:
(i) standard operator’s access’ cost including but not limited to SMS/GPRS/UMTS/data charges/roaming charges and such other charges as prescribed by Celcom from time to time and shall be payable by you in accordance to Celcom’s policy and requirements; and
(ii) data or standard charges for any actions beyond the Service (including but not limited to browsing beyond the Site and downloading contents).


4.3 You may opt out from the subscription of the chargeable Content at any time by sending a specific keyword via SMS for the respective Content as displayed on the Site, or via the Site.


Celcom reserves the right, at its sole discretion, to modify, discontinue or terminate the Content, Site or Services or to modify these Terms of Service, at any time and without prior notice to you. Any amendments to the Terms of Service will be effective when the updated Terms of Service is posted on the Site. You shall be responsible to check the Site periodically for the updated version of the Terms of Service. By continuing to access or use the Site or the Services after the modified Terms of Service have been posted, you agree to be bound by the modified Terms of Service. If the modified Terms of Service are not acceptable to you, you shall discontinue your access to the Site or the usage of the Service.


6.1 All right, title and interest including but not limited to copyright and other intellectual property rights in and to the Service (including but not limited to all graphic/image and text files) are owned by Celcom. The Content you access and view as part of the Service is owned and controlled by Celcom and Celcom’s licensors. The rights aforementioned are protected by Malaysian copyright laws, other applicable copyright laws, and international treaty provisions. Celcom retains all rights not expressly granted herein.


6.2 Celcom reserves the right to refuse permission to use this Service to any individual for any reason whatsoever, and may do so without notice.


The Service (including but not limited to the Content) shall not be returned for a refund. Should you experience any technical problems with the Service or Content, you may contact Celcom’s online support for assistance on technical issues.


You shall make every attempt to safeguard your data and other files during the installation, when upgrading or installing an update. Celcom shall not assume any responsibility for the loss of data and or any other losses that result from installation, upgrading or updating of the Service.


If your download request is incomplete or incorrect or if for any reason whatsoever Celcom is unable to provide or deliver the Service to your equipment as requested, Celcom reserves the right to decline to provide the Service without further notice to you. Celcom shall not be liable in any way for failures, defects or delays in the delivery of the application of the Service for any reason whatsoever.


10.1 Termination and Suspension by Celcom


10.1.1 Celcom reserves the right at its sole discretion to cancel, terminate, suspend or disable your Account or the Service without prior notice to you:
(a) for any reason whatsoever;
(b) if the information provided by you for the creation of the Account is inaccurate or incomplete;
(c) if you breach any of these Terms of Service; or
(b) if your mobile service is deemed to have been terminated by Celcom (if applicable).


10.1.2 Subject to Clause 10.1.1 above, you agree that Celcom shall not be liable to you or any other party for such cancellation, withdrawal, termination or suspension.


10.2 Termination by you


10.2.1 You may:
(a) terminate your Account at any time by sending an email to contactus@bigwin.com.my (“Termination”);
(b) deactivate your Account on the Site (“Deactivation”).


10.2.2 Upon Termination:
(i) you shall not be entitled receive any rebate or refund due from Celcom to you; and
(ii) you shall be required to create a new account should you wish to use the Service.


10.2.3 Upon Deactivation, you may reactive your Account at the Site should you wish to use the Service.


You shall indemnify Celcom, its related and affiliated corporations against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against Celcom, its related and affiliated corporations in connection with any breach by you of these Terms of Service or in connection with the Service.


To the maximum extent permitted by applicable laws, in no event shall Celcom, its related and affiliated corporations be liable to you or anyone else for any direct, indirect, special, exemplary, consequential damages, or any damages whatsoever including but not limited to loss of use, loss of revenue or profits, injury or lost or damaged data or other commercial or economic loss whether in action of contract, negligence or other tortuous, arising out of or in connection with your access, use of, or your inability to access or use the Service or the performance or non performance of the Service, the software or related documentation. Your usage of the Service is entirely at your own risk.


The Service is provided on an “As Is” basis without any representation or warranties of any kind whether express or implied. Celcom and its related and affiliated corporations disclaim and exclude all warranties relating to the content, information, services relating to or in connection with the Service including but not limited to, all warranties of merchantability, fitness for a particular purpose, title, non-infringement, compatibility, security and accuracy. You shall assume the entire risk as to the results and performance of the Service and related documentation.


Celcom neither assume nor accept any liability (including but not limited to any loss, damage, theft, misuse, malfunction) of your hardware or data or anything else that you may own regardless of the cause or reason for such misfortune. Celcom, its officers and employees will not be liable for lost profits, loss of business or other consequential, special, indirect or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party. Celcom and its subsidiaries, affiliates, officers, agents or other partners and employees and or servants shall be responsible or liable for any information, data, text, photographs, graphics, videos, reviews, messages of other materials publicly uploaded and made available for viewing via the Site. You are entirely responsible for the Content that you consume via the Service. Celcom does not in any way endorse or guarantee the accuracy, integrity or quality of such content.


15.1 Without limiting the generality of any provision in these Terms and Conditions, Celcom shall not be liable for any failure to perform its obligations herein caused by an act of God, insurrection or civil disorder, military operations or act of terrorism, all emergency, acts or omission of Government, or any competent authority, labour trouble or industrial disputes of any kind, fire, lightning, subsidence, explosion, floods, acts or omission of persons or bodies for whom Celcom has no control over or any cause outside Celcom’s reasonable control.


15.2 Notwithstanding Clause 14.1 above, you shall remain liable to pay all fees and charges which are outstanding and/or due and payable to Celcom.


15.3 The Service may occasionally be affected by interference caused by objects beyond Celcom’s control such as buildings, underpasses and weather conditions, electromagnetic interference, equipment failure or congestion in Celcom’s system or telecommunication systems. In the event of such interference, Celcom shall not be responsible for any inability to use or access the Service, interruption or disruption of the Service.


16.1 These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, and you hereby subject to submit to the non-exclusive jurisdiction of the Malaysian courts.


16.2 Subject to Clause 16.1 above, these Terms and Conditions are subject to the Communications and Multimedia Act 1998 and any applicable subsidiary legislation, rules, regulations, directives and/or orders.


16.3 If any of the provision of these Terms and Conditions should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.


16.4 Any failure by Celcom to enforce any terms herein, or any forbearance, delay or indulgence granted by Celcom to you will not be construed as waiver of Celcom’s rights provided under this Agreement.


Celcom welcomes and encourages you to provide feedback, comments and suggestions for improvements to the Site and Services ("Feedback"). You may submit the Feedback by sending an e-mail to contactus@bigwin.com.my. You acknowledge and agree that all Feedback will be the sole and exclusive property of Celcom and you hereby irrevocably assign to Celcom and agree to irrevocably assign to Celcom all of your right, title, and interest in and to all Feedback, including without limitation all geographical patent rights, copyright rights, trade secret rights, and other proprietary or intellectual property rights therein. At Celcom’s request and expense, you will execute documents and take such further acts as Celcom may reasonably request to assist Celcom to acquire, perfect, and maintain its intellectual property rights and other legal protections for the Feedback.

1. INTRODUCTION


1.1 Big Win’s website (“Big Win’s Website”) is operated by Celcom Mobile Sdn Bhd (Company No. 227910-A)(“Celcom”) subject to Big Win’s Website Terms of Service made available at www.bigwin.com.my(“Terms of Service”) and this privacy policy (“Privacy Policy”). Your use of the Big Win’s Website and/or other services that may be provided by other means or media by Big Win including those as set forth in the applicable Terms of Service (“Services”) constitutes your acceptance of this Privacy Policy and the Terms of Service.


1.2 This Privacy Policy applies to information that you provide to Celcom via Big Win’s Website and/or by use or subscription of the Services.

4. THE TYPE OF INFORMATION CELCOM COLLECTS


4.1 PERSONAL INFORMATION COLLECTION


4.1.1 Celcom collects and uses your Personal Data (as defined in Personal Data Protection Act 2010) only with your knowledge and consent when you use Big Win Website and/or register or subscribe to the Services and/or when you respond to communications from Celcom (such as contests, questionnaires or surveys) and other information through your postings or responses to Celcom.


4.1.2 In addition, when you request pages from the Big Win Website server, it automatically collects some information about your preferences, including your IP address for administration purposes including but not limited to website maintenance, server maintenance, systems diagnostics and online billing diagnostics.


4.2 THIRD PARTY INFORMATION.

5. USE OF YOUR PERSONAL INFORMATION

(iv) for customer administration;

(xiii) to verify and process payment when you use the Big Win’s Website and/or the Service or purchase goods and services from Big Win’s Website;

(xiv) to verify and record your personal particulars including comparing it with information from other sources and using the information to communicate with you;

(xv) conduct market research of the users of Big Win’s Website and Service including the number of users, the frequency of use, profile of users and using such analysis for our business plans, the enhancement of our products and services, targeted advertisements and conveying such information in broad aggregate terms to third parties who have or propose to have business dealings with Celcom;

(xvi) to send you information, promotions and updates including marketing and advertising materials in relation to our goods and services and those of third party organisations selected by Celcom;

(xvii) to comply with any order of court or directive from authorities investigating any alleged offence, misdeed and/or abuse or to enforce any of the terms in the Terms of Service, where such action is necessary to protect and defend the rights or property of Celcom;

(xviii) to Celcom’s shareholders, related corporations and affiliated companies for purposes of providing any goods or services to the customer;

(xix) to payment channels including and without limitation, financial institutions for purposes of maintaining financial records, assessing or verifying credit and facilitating payments of any amount due to Celcom pursuant to the Terms of Service;

(xx) to other service providers or to parties nominated by Celcom either solely or jointly with other service providers, for purposes of establishing and maintaining a common database of customers; and/or

(xxi) to Celcom’s professional advisors on a need to know basis.

Save in accordance with the Terms of Service, Clause 5.1 above and except as permitted or required under any enactment, law, statute or code, Celcom will not use or disclose the your personal information without your prior written consent.


6. ACCURACY OF PERSONAL INFORMATION


6.1 You are responsible for maintaining and updating the registration information in your User Account with current and complete information. You may access, edit or remove the personal information by signing in to your User Account and following the directions listed therein.


6.2 Failure to provide complete and correct information to Celcom as required in the Terms of Service, may result in the your application for the Service being rejected, termination or suspension of the Service.


6.3 Celcom strives to maintain complete, current, and accurate information about its customers. Any inaccurate information that is brought to Celcom’s attention will be corrected as soon as reasonably practicable upon receipt of such notification.


7. DISCLOSURE OF YOUR PERSONAL INFORMATION


7.1 Celcom will not sell or rent your personal information to third parties. Save as provided for herein, Celcom will not disclose personal information about you to any third party without your consent.


7.2 Celcom may from time to time, contact you on behalf of external business partners about particular goods, offers or services that may be of interest to you. In those cases, personal information that may identify you will not be transferred to the third party. All communication whether from Celcom or Celcom’s business partners will be sent to you by Celcom.


7.3 Celcom may however, need to work with Authorised Third Parties to provide part or all of the Big Win’s Website, the Service and/or other services to you or to perform market research and statistical analysis. In such situations, Celcom will share your personal information as is necessary for the Authorised Third Party to perform these services, on a strictly confidential basis. 8. LINKS TO OTHER WEB SITES


Web Site’s Website may contain, from time to time, links to other web sites. Celcom is not responsible for the privacy practices or the content of such websites or of any third party. You should review the privacy policies of such websites when you visit them. This Policy applies solely to information collected by Big Win Website.


9. COOKIES

10.2 If you wish to correct, change or update your particulars in your User Account, by following the steps provided at Big Win’s Website. You will need to have your user ID and password.


10.3 You may terminate and deactivate your User Account by sending an e-mail to contactus@bigwin.com.my specifying your user ID, and expressly state that you wish to terminate your User Account.


10.4 You can write to Celcom at any time to obtain details of the personal information Celcom holds about you. Please write to:
contactus@bigwin.com.my quoting your name, address, user ID and User Account details. It would be helpful if you also provide brief details the information that you need. Celcom may charge a reasonable sum as permitted by the Data Protection Act 2010 for administrative charges of providing you with the information required.


11. SECURITY


11.1 The Internet is not a secure medium, and communications over the Internet may be subject to third-party interception. Celcom shall not accept responsibility for any unauthorised access or loss of personal information, save in accordance with the Terms of Service.


11.2 Celcom has implemented security policies, rules and technical measures to protect your personal information from unauthorised access, improper use or disclosure, unauthorised modification, unlawful destruction or accidental loss. All our employees and data processors, who have access to and are associated with the processing of personal information, are obliged to respect the confidentiality of your personal information.


11.3 While Celcom cannot guarantee that loss, misuse or alteration of data will not occur; Celcom shall use reasonable endeavours to prevent such unfortunate occurrences.


11.4 You must remember to log off from your User Account and close the browser window after use to prevent access by unauthorised parties. You must not, at any time, divulge your user ID and password to any third party.


12. TRANSFERRING YOUR INFORMATION OUTSIDE OF MALAYSIA


It may be necessary to transfer your personal information to other group companies or service providers located in countries outside Malaysia. This may happen where Celcom’s servers or suppliers and service providers are based outside Malaysia or where you use the Celcom’s and/or Service from countries outside Malaysia.
